Proskauer Rose, the MTA’s white shoe outside counsel, was still hard at work last Friday.
The firm billed the MTA for $1.7 million – and counting – in transit union related work so far this year. And it was still working for the MTA on Friday – the same day a contract arbitration decision was finally made.
On Friday, however, its work had nothing to do with Roger Toussaint.
Instead, MTA Chairman Peter Kalikow made a deposition at Proskauer’s office regarding allegations made against the MTA’s former security directors Nicholas Casale and Lou Anemone.
If you remember, Casale and Anemone were fired in 2003 for allegedly making up a confidential source who said a Long Island Rail Road President Kenneth Bauer took improper gifts from a Plasser American, a contractor.
Anemone reportedly said the source was MTA labor negotiator Gary Dellaverson – but the MTA long maintained Gary wasn’t the source.
Bauer was later found guilty of violating the MTA’s ethics codes.
And Anemone and Casale sued to clear their names and that suit is giving Proskauer Rose plenty of work.

Casale and Anemone made the mistake of thinking they had a real job. Hired post 9/11, they thought their job was to secure the MTA properties against possible terrorist attacks. Pataki and Kalikow had no intention of expending such resources. It will be interesting to see how their name clearing endeaver pans out.
